Senators Propose AI Accountability Act: No Section 230 Immunity for AI Act

On Wednesday, June 14, 2023, U.S. Senators Josh Hawley (R-Mo.) and Richard Blumenthal (D-Conn.) introduced the No Section 230 Immunity for AI Act, a bipartisan legislation aimed at addressing the potential harms of generative AI. This act clarifies that Section 230 immunity, which shields online platforms from user-generated content, will not apply to claims related to generative AI (artificial intelligence). The goal is to provide consumers with the necessary tools to protect themselves from harmful content resulting from advancements in AI technology.

They mentioned, for example, that the proliferation of AI-generated "deepfakes," realistic but false images or videos of real individuals, has raised concerns about the consequences faced by ordinary people who are misrepresented, adding that the Companies involved in this process should be held accountable in court. Senator Hawley emphasizes that mistakes made with Section 230 and Big Tech must not be repeated, and companies should be held responsible when their technologies harm innocent individuals. Senator Blumenthal emphasizes the need for AI companies to take responsibility for their business decisions, without the protection of Section 230, and advocates for establishing safeguards and regulations to protect the public in the era of AI.

The No Section 230 Immunity for AI Act would amend Section 230 by removing immunity from AI companies in civil claims or criminal prosecutions related to generative AI. It also empowers individuals harmed by generative AI to file lawsuits against AI companies in federal or state courts.

On May 16, 2023, Senators Hawley and Blumenthal conducted a significant hearing on AI oversight, where all three witnesses, including OpenAI CEO Sam Altman, agreed that Congress needed to take action. They acknowledged the rapid advancements in generative AI technology, such as large language models and art generators, and their profound impact on various aspects of American life.

Senator Hawley recently announced five guiding principles for future AI legislation, highlighting the importance of addressing the regulatory framework surrounding AI technologies.
