U.S. ITC to Examine Claims that Hytera Is Unlawfully Infringing Motorola Solutions’ Patents

Potential Remedies Include Enjoining Hytera from Selling and Marketing Infringing Products in the U.S.

CHICAGO / CRWE PRESS RELEASE / April 28, 2017 – Motorola Solutions, Inc. (NYSE: MSI) (“Motorola Solutions” or the “Company”) today announced that the U.S. International Trade Commission (the “ITC”) has voted to institute an investigation into unfair trade practices by Hytera Communications Corporation Limited (SHE: 002583) (“Hytera”). The investigation is based on a complaint filed by Motorola Solutions on March 29, 2017.

The ITC’s investigation will examine whether Hytera is unlawfully importing and selling two-way radio equipment and systems and related software and components that infringe Motorola Solutions’ patents.

If the ITC’s investigation determines that Hytera has engaged in unlawful practices, the ITC may issue an exclusion order to halt the importation of the infringing products, as well as a cease-and-desist order to stop the sale and marketing of the infringing products in the United States.

Mark Hacker, general counsel and chief administrative officer of Motorola Solutions, said, “We are pleased the ITC will investigate Hytera’s trade practices, as we believe they are both unscrupulous and unlawful. Motorola Solutions is known for pioneering technology innovation. As the world’s leading provider of two-way radio equipment and systems, we are committed to vigorously defending our valuable intellectual property on behalf of our customers, shareholders, employees, partners and other stakeholders. We will continue our efforts to stop Hytera’s illegal and anticompetitive behavior, and look forward to a prompt decision by the ITC.”

Motorola Solutions also filed patent infringement complaints with the Regional Court of Düsseldorf in Germany (the “Regional Court”) against Hytera on April 18, 2017, and patent infringement and trade secret misappropriation complaints on March 14, 2017, in the U.S. District Court for the Northern District of Illinois.
